Valid for all purchases made via GIVO Group B.V. domains.
Scope and Contracting Party
These General Terms and Conditions apply to all contracts concluded between GIVO Group B.V. (hereinafter "GIVO", "We", or "Us") and the customer (hereinafter "Buyer", "You") via our online platforms.
Intermediary Role: GIVO acts exclusively as an intermediary agent. We sell Vouchers that allow you to book experiences provided by independent third-party suppliers ("Partners" or "Tour Operators").
Contractual Relationships:
Voucher Purchase: The contract for the purchase of the Voucher is strictly between You and GIVO.
Experience Provision: Upon redemption and booking, a separate contract regarding the execution of the experience is formed directly between the Redeemer and the Partner. GIVO is not responsible for the performance, safety, or quality of the experience.
Package Travel Disclaimer: Unless expressly stated otherwise, the Vouchers sold constitute "single travel services" and do not constitute a "Package" under the EU Package Travel Directive (2015/2302). GIVO does not act as a tour organizer.
The Voucher Redemption Restrictions
Nature of the Voucher: The Voucher is a value instrument that entitles the holder to book a specific experience or choose from a selection of experiences on the GIVO platform.
Strict Online Redemption:
Platform Only: The Voucher MUST be redeemed exclusively via a GIVO website
Not Accepted at Venue: The Voucher is NOT a direct means of payment. You cannot present the Voucher code directly to the Partner (e.g., at the hotel reception or ticket counter) without a prior booking confirmation from GIVO.
Consequence: Partners are contractually instructed to refuse service if a valid GIVO Booking Confirmation cannot be presented.
Availability of Service: GIVO strives to keep the Platform accessible 24/7 but does not guarantee uninterrupted availability. Temporary downtime (e.g., for maintenance or technical failure) does not entitle the Holder to redeem the Voucher directly with the Partner. GIVO is not liable for any loss of opportunity to book a specific date caused by Platform downtime.
Transferability: Unless otherwise stated, Vouchers are transferable. The holder of the Voucher is entitled to redeem it.
Ordering Process and Conclusion of Contract
The presentation of products on our websites constitutes a non-binding catalog. By clicking the "Buy Now" (or similar) button, you place a binding order.
The contract is concluded when we send you an Order Confirmation and the Voucher (via email or post).
You are responsible for the accuracy of the email address provided. GIVO is not liable for non-delivery if the email address is incorrect or if the email is blocked by spam filters.
Prices and Payment
Total Price Display: Prices shown at checkout are the total payable by you, including any applicable consumer taxes that we are required to charge or display.
Debt Discharge: Payment of the purchase price to GIVO constitutes full and final discharge of your obligation to pay for the experience. The Partner has no claim against you for the price of the experience covered by the Voucher.
Validity and Extension
Standard Validity: Unless otherwise specified on the product page, Vouchers are valid for three (3) years, calculated from the end of the calendar year in which the Voucher was purchased.
Expiry: After the validity period expires, the Voucher can no longer be redeemed, and the value is forfeited. Cash refunds for expired vouchers are excluded.
Right of Withdrawal (14-Day Cooling-Off Period)
Right to Withdraw: You have the right to withdraw from the Voucher purchase contract within 14 days without giving any reason.
Process: To exercise this right, you must inform us (via email/contact form) clearly of your decision. We will refund the payment using the same means of payment used for the initial transaction.
Premature Expiry & Acknowledgement:
The right of withdrawal expires immediately if the Voucher has been redeemed and a specific date for an experience has been booked/reserved with a Partner within the 14-day period.
By making such a booking, you expressly request the service to begin and acknowledge that you thereby lose your right of withdrawal regarding the Voucher purchase.
Booking, Cancellation, and No-Shows
Booking: Booking requests are subject to the availability of the Partner. The mere possession of a Voucher does not guarantee availability on a specific date.
Partner's Rules: Once a booking is confirmed, the cancellation and modification policies of the respective Partner apply.
Cancellation by Redeemer:
If you wish to cancel or reschedule a booked date, you must do so in accordance with the Partner's specific cancellation policy (visible during the booking process).
Late cancellations may result in the forfeiture of the Voucher.
No-Show: If you fail to appear for a booked experience without valid cancellation ("No-Show"), the Voucher is considered fully redeemed and cannot be used again.
Cancellation by Partner: If the Partner cancels the experience (e.g., due to weather or Force Majeure), your Voucher remains valid, and you may rebook a new date or exchange the Voucher. GIVO is not liable for travel or accommodation costs incurred due to such cancellations.
Exchanges
During the validity period, Single-Purpose Vouchers may be exchanged for other experiences on the GIVO platform.
Liability
GIVO's Liability: GIVO is liable for the issuance and technical functionality of the Voucher and the Platform.
Exclusion of Liability for Experience: To the fullest extent permitted by applicable law, GIVO explicitly excludes liability for:
The quality, safety, or execution of the Experience provided by the Partner.
Personal injury, property damage, or other damages occurring during the Experience.
Information provided by the Partner regarding the experience (e.g., duration, difficulty level) which is synchronized via API.
Statutory Rights: Nothing in these Terms shall exclude or limit GIVO's liability for intent, gross negligence, or death/personal injury caused by GIVO's own negligence, or any other liability which cannot be excluded by Dutch law.
Data Protection
We process your personal data in accordance with the GDPR.
Data Transfer: To facilitate your booking, strictly necessary data (e.g., Name, Phone Number) will be transferred to the Partner via our API integration.
Applicable Law and Jurisdiction
These Terms and Conditions and all legal relations between GIVO and the Buyer are governed by the laws of the Netherlands.
For consumers within the EU, mandatory statutory consumer protection regulations of the country in which the consumer habitually resides remain unaffected.
